Provisions of Dalian Municipality on Strengthening

(Promulgated by Dalian Municipal People's Government on November 2, 1988 in document No. 216; amended in accordance with Decision of Dalian Municipal People's government on Amending Some Municipal Rules on March 10, 2003)

Article 1 In accordance with the Law of the People?ˉs Republic of China on Control of the Entry and Exit of Aliens, and the Interim Regulations of the state council of People?ˉs Republic of China on Governing Representative Offices of Foreign Enterprises, the provisions are formulated in order to reinforce the safety control of offices established in Dalian by foreign enterprises, and protect the lawful rights and interests of the enterprises and foreigners.

Article 2 All the offices established by foreign enterprises in Dalian municipal area, including Chinese and foreign personnel employed by the offices as well as their dependents, shall abide by the provisions.

Article 3 Dalian public security bureau, the competent authority in charge of the safety control of offices established in Dalian by foreign enterprises, shall discharge duty according to law, and carry out safety control and service conscientiously.

Article 4 The offices established in Dalian by foreign enterprises as well as their employed Chinese and foreign personnel shall abide by China law, regulations and relevant rules, and maintain economic, technological and public security administration order consciously.

Article 5 Any foreign enterprise desiring to establish its representative office in Dalian municipal must, within 10 days after securing the approval or going through registration of industrial and commercial enterprises, apply to the Dalian Public Security Bureau together with relevant certificates (copies or facsimiles) for registration, and take out residence register.

A representative office, when desiring to modify registration items, must go to the original registration organ within 3 days together with the register and relevant certificates and go through the modification formalities; when desiring to dissolve the office or stop operation temporarily, must go to the original registration organ together with relevant certificates, go through the formalities for record, and return back the residence register.

Article 6 The daily?business operating place of the offices and the residence place of the employed foreigners shall be subjected to the safety supervision by the public security organ. In case the business offices or the residences are detrimental to the safety control, they should move to the permitted safe areas within specified time.

Article 7 The special seal of the offices established in Dalian shall be examined and registered by the public security organ. Without examination and registration, the offices are not allowed to engrave or start to use the seal.

Article 8 The employed foreigners in the offices established in Dalian and their dependents shall, within 10 days of entry, apply to the public security organ for obtaining the residence permit; the employed overseas Chinese, compatriots from Hong Kong, Macao and Taiwan in the offices and their dependents shall, within 10 days of entry, apply to the public security organ for obtaining temporary residence permit.

To go through the residence permit formalities, the concerned party shall present valid passport visas, health certificates, and credentials pertaining to residence causes for examination, fill in the residence application form, and provide two recent personal ( half-length, passport-size ) photos. To go through the temporary residence permit formalities, the concerned party shall present relevant identity certificates, health certificates, and credentials pertaining to their temporary residence causes for examination, fill in the temporary residence application form, and provide two recent personal ( half-length, passport-size) photos.

The permit holder who wishes to modify residence or temporary residence items, shall declare and go through modification formalities in time; the holder who wishes to extend residence period or temporary residence period shall, before the expiration of the residence permit or temporary residence permit, go through the extension formalities.

Article 9 Foreigners employed in the offices established in Dalian and their dependents who wish to travel in areas that are not open to foreigners during the period of stay shall apply to the public security organ for approval and a travel permit; those who wish to leave China temporarily shall apply to the public security organ for obtaining the reentry visas; those who suffer infectious diseases shall, according to the opinions of the public security organ and health quarantine department, leave the country before the term of stay expires.

Article 10 In the event that the offices established in Dalian by foreign enterprises desiring to employ a foreigner, foreign student studying in China, overseas Chinese, or person from Hong Kong, Macao and Taiwan without a residence permit, the party concerned shall obtain approval of municipal labor department, and apply to the public security organ, together with employment permit and relevant credentials, for modifying identity and residence certificates ; those which employ Chinese staff shall apply to the public security organ, together with household register and relevant certificates, for registration and record .

Article 11 In the event that a foreigner or Chinese who lodges at the office established in Dalian by foreign enterprise or the domicile of the employed foreigner, an application for registration shall be submitted to the public security organ together with the lodger?ˉs passport or relevant certificates.

Article 12 The public security organ shall, in accordance with the provisions of law, impose a warning, fine, detention, order to leave the country within a time limit or deportation, for violating the provisions, in light of the circumstances of the case; if the offence is serious enough to constitute a crime, the judicial organs shall investigate for the criminal responsibility according to law.

Article13 The provisions shall apply to any foreigners, overseas Chinese, and staff from Hong Kong, Macao and Taiwan, who are employed in foreign-invested enterprises (including Chinese-foreign equity joint ventures, Chinese -foreign contractual joint ventures and foreign-capital enterprises) in Dalian.

Article 14 The provisions go into effect on the day of promulgation.
